WWE & The Benoit Estate Case

Atlanta Journal Constitution is reporting that the WWE has refused to hand over documents relating to drug testing and related matters for the Chris Benoit case. WWE filed papers in Fayetteville Superior Court this past Monday which called the request for documents from WWE "abusive and improper and not remotely relevant to the determination of order of death". The discovery motions were originally filed by the estates of Benoit and his wife and son to get this info from the WWE, but WWE has moved to block it to prevent future lawsuits from the families. There is an upcoming court hearing scheduled to determine who will inherit the Chris Benoit estate because neither Chris nor his late wife, Nancy left a will behind. Order of death is what will be key to determine who gets the inheritance, which is being fought over by Chris' father, Michael Benoit and Paul and Maureen Toffoloni, Nancy's parents. According to Atlanta Journal Constitution:

"The Toffolonis and Michael Benoit have sought documents from the WWE pertaining to the company's drug testing, as well as any previous deaths, drugs and illnesses other wrestlers may have suffered as a result of steroids or other performance-enhancing drugs."

WWE attorney Jerry McDevitt insists there is no way that the WWE can be held responsible for the double murder suicide which occurred months ago. Attorneys representing the Benoit estates will try to prove to a judge that the WWE documents are vital to the estate hearing and need to be handed over.
